A&D GROUP GYO – TERMS AND CONDITIONS

These Terms and Conditions regulate the rules regarding the use of the services offered through the website www.adgroupgyo.com (“Site”), operated by A&D Group E-Commerce and Real Estate – İbrahim DURKUT (hereinafter referred to as “A&D Group” or “Company”). Anyone visiting the Site or filling out the contact form shall be deemed to have accepted these terms.

1. Definitions

User/Visitor: Real or legal persons visiting the Site or filling out the contact form.

Buyer: A person who intends to purchase real estate listed on the Site.

Seller/Advertiser: A real or legal person promoting their real estate on the Site via listing.

A&D Group: The company that operates the Site and organizes real estate trade with commission/intermediary services.

Partner Company: Real estate offices and consultants cooperating with A&D Group and sharing listings.

2. Scope of Service

The Site operates for the purpose of publishing and promoting real estate listings and bringing together buyers and sellers.

A&D Group provides brokerage services on a commission basis. The commission rate is specified in the brokerage agreement signed with the parties.

Listings on the Site are published based on information provided by property owners, their legal representatives, or partner companies.

A&D Group does not guarantee the accuracy of the information contained in the listings; responsibility belongs to the advertiser.

3. User Obligations

Users may use the Site only for lawful purposes.

Providing misleading, false, or inaccurate information is prohibited.

The user accepts that the information provided through the contact form is accurate and up-to-date.

Before making any transactions through the Site, the user must personally view the property and confirm the price with the seller.

4. Commission and Payment

A&D Group charges a commission fee from sales it intermediates.

Commission rates are determined according to applicable legislation in Türkiye and the agreements signed between the parties.

Commission practice also applies to sales made to foreign buyers (e.g., Dubai, Qatar, EU countries, USA).

Payment methods may include bank transfer, credit card, international SWIFT transfers, or other methods accepted by A&D Group.

5. Disclaimer of Liability

The accuracy of the information and documents in the listings belongs solely to the seller/advertiser.

A&D Group is not responsible for any errors, omissions, or price changes in the listings.

A&D Group cannot be held liable for direct or indirect damages that may arise as a result of transactions made through the Site.

6. International Transactions

The Site may facilitate real estate purchases by foreign buyers (e.g., Dubai, Qatar, EU countries, USA) by allowing them to review listings.

In international transactions, compliance with the legislation of the relevant country is the responsibility of the users.

Foreign buyers are subject to the applicable Land Registry Law, Turkish Code of Obligations, and foreign investment regulations in Türkiye.

A&D Group provides only brokerage services in international transactions; the legal aspects of purchase and sale are the responsibility of the relevant country’s authorities and the parties.

7. Privacy and Data Protection

The processing of user data is carried out within the framework of the Privacy Policy and KVKK.

Personal data of foreign buyers is also processed in compliance with international data protection regulations such as GDPR (EU) and DIFC Data Protection Law (Dubai).

8. Suspension of Service

A&D Group reserves the right to reject communication requests or restrict access to the Site of users who violate these terms.

The Site may be temporarily unavailable due to maintenance or technical reasons.

9. Dispute Resolution

These Terms and Conditions are subject to Turkish Law.

For transactions in Türkiye, Burdur Courts and Enforcement Offices shall have jurisdiction.

For international transactions, the competent court and applicable law may be determined by agreements separately signed between the parties.
